Web Wiz Hosting Services Acceptable Use Policy
This policy is subject to change, so please check regularly for updates. This policy is in addition to Web Wiz Terms and Conditions.
This acceptable use policy outlines the terms governing your use of our hosting services, including shared web hosting, shared reseller web hosting, enterprise web hosting, hyper-v virtual server, and dedicated server hosting.
Your use of our services means that you agree to comply with all the policies in this acceptable use policy, which supplement our Web Wiz Hosting Services Terms and Conditions.
Where the context admits: "We", "Us", "Our", "Web Wiz", includes Web Wiz Ltd. or any party acting on Web Wiz Ltd. implicit instructions. "You" includes the person purchasing the services or any party acting on the customer's instructions.
1. Resource Usage
1.1. Some hosting services offer 'unlimited' and 'unmetered' bandwidth. However, if a customer is found to be monopolising the available resources, Web Wiz reserves the right to immediately suspend that service. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our network. Customers may be offered an upgrade option if necessary.
2. Prohibited Uses
2.1. You may use your hosting services only for lawful purposes. You and each authorised user may not use your services for:
2.1.1. In any way that violates any applicable local, national, or international law or regulation, including copyright or other intellectual property laws.
2.1.2. In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
2.1.3. For the purpose of causing harm or attempting to harm minors or any other person in any way.
2.1.4. To send or request unsolicited or unauthorised advertising or promotional material or any similar form of solicitation (spam) is prohibited. Maintaining an open SMTP relay is also prohibited.
2.1.5. To knowingly transmit any data, send or upload any material that contains viruses, malware, spyware, ransomware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
2.1.6.
In any way that may hinder another person's use of the services provided by us to any other person.
2.1.7. Gaming servers and gaming services.
2.1.8. Crypto/Data Mining.
2.2. Our shared web hosting and shared reseller web hosting services are intended to be used to host websites. Web Wiz reserves the right to withdraw support or suspend the service where:
2.2.1. Use more than 5% of our servers processing capacity. Many activities can cause such issues, including web applications, intensive databases, ASP.NET, Classic ASP, PHP, or HTTP operations.
2.2.2. Use the hosting services as an offsite backup facility. All files uploaded to our servers must be visible and accessible to the outside world, unless they are necessary for the functioning of the website to which they belong. Web Wiz reserves the right to delete files or directories that are not visible on the web without providing prior notice to you.
2.2.3. Exceed a disk space limit of 15,000 MB for each website, 50,000 MB for each mailbox, 5,000 MB for each MySQL Database and 5,000 MB for each SQL Server Database.
2.2.4. Database services are for the exclusive use of storing the data of websites hosted on our network and can not be used to store non-website data or with services outside of the Web Wiz network.
2.2.5. To send bulk email whether opt-in or otherwise is strictly forbidden. All outgoing mail is monitored and filtered.
2.2.6. Use FTP services by persons outside of the account holders organisation to transfer files to or from our network. The use of applications which maintain a constant FTP connection to upload at regular intervals is also forbidden.
2.2.7. Use the hosting services for cloud file hosting to host 'file hosting' or office applications applications.
2.2.8. Databases that use files stored on the web server are permitted as long as the total file size of the database is below 250 MB in size. This includes, but not limited to, Microsoft Access, Microsoft SQL Server Compact, SqlLite, and RavenDB.
2.2.9. The streaming of video and music is permitted within moderate bandwidth and storage limits, as long as you own the copyright for this content. Web Wiz reserves the right to define what constitutes moderate in this context.
3. Content Standards
3.1. Any data, information, or communication made on or using the services by any person must adhere to appropriate and lawful standards of accuracy, decency, and lawfulness. These standards will be applied at our discretion, acting reasonably. Specifically, you warrant and undertake that any data and each such communication shall at all times be:
3.1.1. Submitted lawfully and without infringement of any Intellectual Property Rights of any person.
3.1.2. Be accurate (where they state facts).
3.1.3. Be genuinely held (where they state opinions).
3.1.4. Not be defamatory, obscene, seditious, vulgar, pornographic, sexually explicit, discriminatory, or deceptive.
3.1.5. Not be abusive, threatening, offensive, harassing, invasive of privacy, racist, sexist or xenophobic.
3.1.6. Not promote illegal activity.
3.1.7. Not give the impression that they emanate from Web Wiz, if this is not the case.
3.1.8. Not to be used this to impersonate any person or to misrepresent your identity or affiliation with any person.
3.1.9. Unlikely to result in offense, embarrassment, or annoyance to any individual or group.
4. Suspension and Termination
4.1. Web Wiz will determine, at our discretion, whether there has been a breach of this acceptable use policy through your use of the hosting services. When a breach of this policy has occurred, we may take such action as we deem appropriate.
4.2. Failure to comply with this acceptable use policy constitutes a material breach of our terms and conditions upon which you are permitted to use the hosting services, and may result in us taking any or all of the following actions:
4.2.1. Immediate, temporary or permanent withdrawal of your right to use the hosting services .
4.2.2. Immediate, temporary or permanent removal of data uploaded to our servers
4.2.3. Issue of a warning to you
4.2.4. Issue legal proceedings against you for reimbursement of all costs, including reasonable administrative and legal costs, on an indemnity basis resulting from the breach.
4.2.5. Disclose such information to law enforcement authorities when we reasonably feel it is necessary.
4.3. We are not responsible for any actions taken in response to breaches of this acceptable use policy. Our responses are not limited, and we may take any other action that we reasonably deem appropriate.
WEB WIZ Ltd. RESERVES THE RIGHT TO CHANGE THIS ACCEPTABLE USE POLICY AT ANY TIME.
Changes to the Acceptable Use Policy will be announced on the 'Web Wiz' website. Failure to receive notification of a change does not make those changes invalid. Current copies of the Acceptable Use Policy will be available on this page. |
